These Terms of Service ("Terms") govern your use of paletti (https://paletti.coynoa.com), an AI personal-color diagnosis service operated by Coynoa Inc. ("Company", "we", "us").
The Korean-language version of these Terms is the official, binding text. In case of any inconsistency between the Korean and English versions, the Korean version shall prevail.
Article 1 (Purpose)
These Terms set out the conditions and procedures for using the Service, the rights and obligations of the Company and Users, and other necessary matters.
Article 2 (Definitions)
- "Service" means the AI-powered personal-color diagnosis service that analyzes the User's photograph and delivers a personalized catalog (Total / Makeup / Hair) via email.
- "User" means any person who agrees to these Terms and uses the Service. paletti does not require account registration; entry of an email address and agreement to these Terms and the Privacy Policy is sufficient.
- "Content" means photographs uploaded by Users and the catalog (text, images, recommendations) generated and delivered by the Company through the Service.
- "AI Diagnosis" means the automated processing in which a model operated by an external AI service provider analyzes the User's photograph to generate the catalog.
- "Advertising" means third-party commercial advertisements displayed on the Service.
Article 3 (Posting and Amendment of Terms)
- The Company posts these Terms on the initial screen of the Service and on the diagnosis request page so that Users may easily review them.
- The Company may amend these Terms within the limits set by applicable laws, including the Act on the Regulation of Terms and Conditions, the Personal Information Protection Act, and the Act on Promotion of Information and Communications Network Utilization and Information Protection (the "Information and Communications Network Act").
- Amendments will be announced at least 7 days before the effective date through in-Service notices, stating the effective date and reasons.
- Material or unfavorable amendments will be announced at least 30 days before the effective date, and the Company may additionally notify Users by reasonable means such as email.
- If you do not agree to amended Terms, you may discontinue use of the Service. If you continue to use the Service after the effective date, you are deemed to have agreed to the amended Terms.
Article 4 (Interpretation)
- Matters not specified in these Terms shall be governed by separately posted operational policies, detailed guidelines, applicable laws, or generally accepted commercial customs.
- The Korean version of these Terms is the official, binding text. The English version is provided for convenience only.
Article 5 (Provision of the Service)
- The Company provides the following services:
- Generation and email delivery of AI personal-color diagnosis catalogs based on User photographs;
- Web viewing and sharing of catalog result pages for a limited period;
- Diagnosis-related content such as the blog and FAQ;
- Any other services developed by the Company or offered in partnership with third parties.
- The Service is provided free of charge, and the Company funds operations primarily through advertising.
- The Company does not guarantee a specific diagnosis processing time. Results are typically delivered within several minutes to several hours, but delays may occur due to the external AI service provider.
- The Company may introduce paid plans (subscription or one-time purchase) in the future, in which case payment and refund terms will be added by a separate agreement or an amendment to these Terms.
Article 6 (Advertising)
- The Company may display advertising on the Service, including on result pages.
- Advertising may include third-party networks such as Google AdSense. Content, accuracy, legality, and reliability of such advertising are the responsibility of the advertiser.
- Transactions you enter into with third-party advertisers are solely between you and the advertiser. The Company is not responsible for any disputes or losses arising from such transactions, except where the Company is at fault through willful misconduct or gross negligence.
Article 7 (Modification or Suspension of the Service)
- The Company may modify all or part of the Service for operational or technical reasons, with prior notice when reasonably possible.
- The Company may temporarily suspend all or part of the Service in the following cases:
- Maintenance, replacement, or repair of service equipment;
- Failure or downtime of external AI service providers or cloud infrastructure providers;
- Discontinuation of services by telecommunications carriers;
- Force majeure events such as natural disasters, national emergencies, or government regulations beyond the Company's control.
- Where suspension can be foreseen, the Company will provide advance notice. Where advance notice is impossible, notice will be provided after the fact without undue delay.
Article 8 (Formation of Use Agreement)
- A use agreement between you and the Company is formed when you enter your email address on the Service, agree to these Terms and the Privacy Policy, upload your photograph, and submit a diagnosis request.
- The Company may decline a request or terminate an existing use agreement if:
- The User is confirmed to be under 14 years of age;
- The request violates these Terms or applicable law;
- The request appears to be automated, abusive, or otherwise not in good faith.
Article 9 (User Obligations)
- Users shall not engage in the following:
- Uploading photographs of another person without that person's consent;
- Uploading photographs of children under 14;
- Uploading pornographic, violent, or otherwise inappropriate images;
- Uploading images that infringe third-party copyrights, portrait rights, trademarks, or other rights;
- Submitting bulk or automated requests via bots or crawlers that place undue load on the Service;
- Falsifying, altering, or redistributing results in a manner that misrepresents the Company as having issued such results;
- Any conduct that violates law, public order, or good morals.
- Users who breach these obligations and cause damage to the Company or third parties shall be liable for such damage.
Article 10 (Restriction on Use by Children Under 14)
- The Service is not intended for children under 14. Children under 14 may not use the Service.
- If the Company becomes aware that a User is under 14, the Company will, without delay, destroy that User's personal data (including email and photograph) and terminate the use agreement.
- Parents or guardians who become aware that a child under 14 has used the Service may contact
privacy@paletti.coynoa.comto request data destruction.
Article 11 (Rights to Content)
- All rights in photographs uploaded by Users belong to the User or the rightful owner. The Company is granted a limited license to process the photograph solely for diagnosis, result delivery, and service-quality purposes.
- After the retention period set out in the Privacy Policy, the Company automatically destroys uploaded photographs. The Company does not use photographs for advertising, marketing, machine-learning training, or any other purpose.
- The catalog generated by AI Diagnosis (text, images, recommendations) is owned by the Company or the external AI service provider. However, you may freely use and share the catalog for your own personal, non-commercial purposes.
- Use of the catalog for commercial purposes (advertising, marketing, exhibition, resale) requires the Company's prior written consent.
Article 12 (Nature and Limits of AI Diagnosis)
- paletti's diagnosis results are provided for personal reference, entertainment, and self-exploration only. They do not constitute medical, cosmetic, psychological, or financial advice of any kind.
- The Company does not guarantee:
- The accuracy, completeness, or fitness for any particular purpose of the results;
- That the results align with your actual appearance, preferences, or lifestyle;
- That the results agree with the opinions of any third-party professional (e.g., makeup artists, hairstylists).
- Users must not rely on the results as the basis for significant decisions in medicine, cosmetic procedures, employment, law, finance, or similar areas. Where such decisions are involved, please consult a qualified professional separately.
- Because AI Diagnosis is fully automated, results may be inaccurate or biased. Pursuant to Article 37-2 of the Personal Information Protection Act of Korea, you have the right to object to, request an explanation of, and request reprocessing of the result, as further described in the Privacy Policy.
Article 13 (Payments and Refunds)
- As of the effective date of these Terms, the Service is provided free of charge and no payment or refund provisions apply.
- If the Company introduces a paid model in the future (subscription or one-time purchase), this Article will be supplemented through a separate payment-and-refund agreement or an amendment to these Terms. The supplemented provisions will reflect applicable consumer-protection laws, including the Act on the Consumer Protection in Electronic Commerce of Korea and the Content Industry Promotion Act, regarding withdrawal of subscription, refunds, and termination.
- Payment instruments (such as card or account numbers) are not stored directly by the Company; they are processed through external payment service providers (only once paid plans are introduced).
Article 14 (Disclaimers)
- The Company is not liable for service unavailability arising from:
- Force majeure such as natural disasters, war, terrorism, power outages, or hacking attacks;
- Suspension of services by telecommunications carriers;
- Failures of external AI service providers, cloud infrastructure providers, or email delivery providers;
- The User's own fault.
- For services provided free of charge, the Company shall not be liable for damages absent willful misconduct or gross negligence.
- The Company makes no express or implied warranty regarding the accuracy or reliability of AI Diagnosis results, nor for any failure of the User to obtain the expected utility from the Service.
- The Company is not responsible for content or transactions on external sites accessed through advertising or third-party links displayed in the Service.
- The Company is not responsible for losses caused by Users' breach of Article 9.
Article 15 (Damages)
- A party that causes damage to the other party through willful misconduct or negligence shall be liable for damages within the scope of ordinary loss.
- Damages payable by the Company are limited to ordinary loss that the Company could reasonably foresee. Damages arising from special circumstances are payable only if the Company was aware of, or should have been aware of, such circumstances.
Article 16 (Personal Information)
- The Company will use commercially reasonable efforts to protect Users' personal information, as set out in the separate paletti Privacy Policy.
- Agreement to these Terms includes separate agreement to the Privacy Policy. Withholding such agreement may restrict access to the Service.
Article 17 (Dispute Resolution and Jurisdiction)
- The Company and the User shall endeavor to resolve disputes through mutual consultation.
- If consultation fails, either party may seek mediation through the Korea Consumer Agency or the Consumer Dispute Mediation Committee.
- Litigation shall be brought before the court having jurisdiction over the Company's registered address (or the address listed in the Company's business registration) as the court of first instance. However, where the User qualifies as a consumer under the Korean Civil Procedure Act, the jurisdiction rules of that Act shall apply.
Article 18 (Governing Law)
These Terms and any disputes between the Company and Users are governed by the laws of the Republic of Korea.
Supplementary Provisions
- These Terms take effect on
2026-06-01. - The history of amendments to these Terms is published separately by the Company as a "Terms Change Log".
